ated instruments, eight priority actions were identified and only one was partially
carried out and corresponds to the water management plan, which has not been
published, thus still lacks proper regulation. Of 38 actions, only four (7.5%) were
fulfilled; as for the projects, only one (20%) was implemented (Fig. 9.3).
The best example of land-use failure is within the tourism sector. For instance,
hotel rooms increased 52% between 2012 and 2016 (Reyes-Orta et al., 2016) other
60% between 2016 and 2018. Boutique hotels, villas, glamping and hostals offered
362 rooms in 2018. The number of restaurants in the valley also increased from
50 in 2016 to78 restaurants in 2018, resulting in an increase in the variation rate by
56%. It should be noted that in a region with very low water availability at least 10
hotels have swimming pools, Jacuzzi, and/or spa facilities, which are forbidden by
these land-use planning laws. In addition, rapid growth of tourism has yielded an
emergent necessity for country housing and support services. Thus, unplanned
urban sprawl is destroying the landscape, and sustainable goals are being dismissed.
For the tourism and urban sectors, an update of the land-use plan has just been published (POEBC 2018) expecting this time to be succesful because it comes with a
bylaw (under review as mentioned above).
As a response to a severe drought, in 2018, wine makers promoted the transfer of
treated water from the nearest metropolis, Tijuana. The project is expected to be a
long-term solution for the everlasting drought situation. But the general mentality of
inadequate water management and conservation still remains. Thus, more water
availability will lead to increased development of vineyards, wineries, tourism, and
residential areas which will push agricultural growth to expand to neighboring
areas. Poor compliance of the evaluated instruments is complex, but we identified
four main reasons: (1) unclear land tenure; (2) ambiguous laws and lack of by-laws,
(3) corruption among all actors, the government agent, the landowner, and the
