The Regulatory Framework
The current regulations in the North Sea industrial fishery within the Common Fishery
Policy are designed to deal with two main issues; by-catch and control of the total
tonnage allowed to be captured. There is, however, a glaring omission in the sandeel
fishery where there is no limit on the quantity which may be caught each year.
Controls on the industrial fisheries are by the following main measures.
a ban on the capture of herring for industrial purposes within EU waters and a
ban on the landing in the EU of herring caught for industrial purposes (R[EEC)
2115/77)
a 10% by-catch upper limit of human consumption species which may be taken
in any of the small mesh industrial fisheries (R[EEC] 3094/86)
a 15% by-catch limit of which not more than 5% may be cod and haddock
within the Norway pout fishery (Article 14 of R[EEC] 3882/91)
