Exploring to develop an institution to exercise ownership rights hierarchically. In accordance with the type and its importance for the ecosystem, economy, and
national defense of natural resources, an institution that exercises ownership rights
hierarchically on behalf of the central and local governments needs to be researched
and established to balance efficiency and fairness. The resources list of spaces in
which publicly owned ownership rights are exercised both directly by the central
government and by local governments shall be developed. The central government
will directly exercise ownership rights on key rivers, lakes, and transboundary rivers.
Conducting water flow and wetland property rights clarification and registration pilots. An exploration should be conducted to develop a water rights system.
A rights clarification pilot to clarify the water eco-space, such as waters and shorelines, shall be promoted. In accordance with the principles of the integrability of the
water ecosystem, water resources ownership rights, use rights, and use volume shall
be clarified. The wetland property rights clarification and registration pilot will be
conducted in the Gansu and Ningxia provinces.
13.2.2 Natural Resources Unified Clarification
and Registration Method (Trial) and 2019 Natural
Resources Unified Clarification and Registration
Temporary Method
To standardize natural resources through a unified clarification and registration
method, and to develop a unified clarification and registration system, MLR, the
State Commission Office for Public Sector Reform, the Ministry of Finances, MEP,
MWR, the Ministry of Agriculture, and the State Forestry Administration jointly
issued the Natural Resources Unified Clarification and Registration Method (Trail)
in December 2016. In July 2019, the 2019 Natural Resources Unified Clarification
and Registration Temporary Method was jointly issued by MNR, the Ministry of
Finances, MEP, MWR, the State Forestry, and the Grassland Administration.
The Method states that the state must develop a unified clarification and registration system for natural resources (Article 2). The unified clarification and registration
system for natural resources should be based on real estate registration (Article 5).
The natural resources administrative department, as the agency in charge of the
unified clarification and registration of natural resources, must conduct registration
management by combining classification and territory. The natural resources administrative department of the State Council is responsible for guiding and supervising
this work; the provincial governments must organize and implement the unified
