legislation or international obligation. If such violations of refugee policy are
“widespread and systematic attacks” on a civilian population, those responsible for
the violations could be prosecuted under the Statute of the International Criminal
Court for crimes against humanity (Rome Statute 1998 art. 7), assuming the jurisdictional prerequisites for the Statute apply.
All in all, the prospects for protecting the rights of refugees in Europe do not
appear good.
